Your Property Platform - Professional Adviser Terms & Conditions

These terms are intended to cover a probationary period of 6 months and layout specific guidelines and remit to help you integrate with YPC. At the end of this period and subject to performance, you may be offered a formal contract or continue on these terms if appropriate.

These terms are subject to change or withdrawal without warning or notice, in whole or in part. You agree to enter the spirit of the document and understand this is a new venture and change is inevitable.

The terms and conditions herein shall constitute the entire agreement between YPC and any modification to these conditions will be binding only if it is evidenced in writing signed by a director of the company and such evidence contains specific reference to those conditions being modified.

Disclaimer YPC disclaims to the maximum extent permitted by law all representations, warranties (express or implied) regarding products, services, quantities, pricing, information, published on our web site, in our brochures or other documents or in any other form or location. Data is constantly updated and therefore is not necessarily accurate, current or complete.

Provision of the products, services, information is on an "as is" basis. In particular YPC disclaims without limitation, warranties of merchantability, fitness for purpose and/or non-infringement.

You agree that YPC shall not be liable for any decision made or action taken based upon reliance on news, information, or any material published or provided in any media by YPC.

You are not authorised to issue statements (verbal or otherwise), make representation or decisions on behalf of YPC. You retain full legal responsibility for your actions. YPC will not accept liability for your actions.

You may use materials produced by YPC for the purposes of marketing products or services to clients. Materials you produce must be seen and authorised by YPC before being made public. You should send the proposed materials to HYPERLINK "mailto:marketing@ypc-group.com" marketing@ypc-group.com, and you can expect a reply usually within 72hours.

Buy-to-Let Investments are NOT Regulated. Some elements of a purchase may fall under a regulatory framework but you understand that the purchase of a Buy-To-Let property is not within a financially regulated framework and therefore may be considered as a high- risk investment.

Allocation of monies received - Any money received will be allocated to any expenses owed before commissions are paid.

Provision of Service - we make no promises that our content or the service itself will be delivered in an uninterrupted, timely, secure or error-free fashion.

Costs incurred in representing YPC product. YPC cannot be held liable and accepts no responsibility for any costs associated with marketing or representing the Property Investor Packages or its products. YPC is responsible solely for the referral of the property. Should a property that a client is purchasing not proceed for any reason the client will be responsible for meeting all the costs involved and will have no claim against YPC. This includes any fee that may have been payable to you.

You are entitled to commission based on the sales generated at the published rate, currently 0.7% inc VAT for Direct Managed Units or 0.4% for successful referrals. We compile a statement and request your invoice monthly, then pay within 60 days of completion.

You must at http://www.yourpropertyplatform.com reserve 1 new sale per calendar month and have at least 1 transaction complete (property or fund) within a 3 month period for any commission payment due in that period. Six consecutive months of failing to reach this target and commission payments may be suspended or stopped completely. This clause will start 3 months after the date this agreement accepted.

You warrant that you are a member of a professional body and either a Financial Advisor, Letting Agent, Estate Agent, Accountant or a Solicitor. Individuals or companies that fall outside the criteria may be admitted at the discretion of a YPC Director.

Your territory is not exclusive. You are not permitted to approach institutions or platforms, or agree national contracts but may recruit introducers to channel business to you.

You must endeavour to attend a Training day annually. You are also welcome to take part in other events funded by YPC.

YourPropertyPlatform will display information about the properties on behalf of third parties for whom they are neither agent nor representatives, and are therefore not responsible for the validity of the details relating to properties shown including pictures which are shown for representative purpose only. Intending purchasers should not rely on them as statements or representations of facts, but must satisfy themselves by physical inspection of the property (or site) in question or otherwise as to their accuracy. Consequently, no information provided in this prospectus (or any linked information) constitutes or forms part of a contract.

You have been given access to contact details for all YPC Group staff who will be available to you during normal office hours (which are Monday to Friday 9am-6pm) and at other times at their discretion. You agree and understand that at times outside office hours it is a privilege given freely by the individual staff member and does not form part of any agreement with YPC or any party. The individual is not remunerated for this extra time and they offer it on the condition that it may not be relied upon. It is given freely in the spirit that it is intended.

You are permitted to make direct sales of available YPC products, within the remit of your qualification level, and entitled to receive commission inline with the Advisor rates at the time of sale.

You understand and agree that you must provide further information requested by YPC staff in an expeditious manner .

Tax - Value Added Tax will be charged, if applicable, at the prevailing rate on the date of supply whether or not included on a quote, order or invoice.

Force Majeure - We shall be under no liability if we are unable to carry out any provision of the agreement for any reason beyond our control including (without limiting the foregoing) Act of God, legislation, war, fire, flood, drought, failure of power of supply, lock-out, strike or other action taken by employees in contemplation or furtherance of a dispute or owing to any inability to procure materials required for the performance of the agreement.

Law - These conditions and all other express terms of the agreement shall be governed and construed in accordance with the laws of England.
